Expunging a record is the process by which a criminal record is destroyed or sealed from the state or federal repository. Pennsylvania Law 18 Pa.C.S. ยง 9122 grants expungement of criminal records under limited circumstances which include:

  • if an individual who is convicted of a crime, reaches the age of 70 years and has been free of arrest or prosecution for 10 years following final release from confinement or supervision,
  • if an individual who has been convicted of summary offenses has been free of arrest or conviction for 5 years following the conviction of the offense,
  • If no disposition has been received or recorded in the repository within 18 months after the day of arrest,
  • If a person 21 years of age or older who has previously been convicted of a violation of section 6308, relating to the purchase, consumption, possession or transportation of liquor or malt or brewed beverages, may petition the court in the county where the conviction occurred to obtain an expungement.
